Terms of Service

What Out of the Blue is — and isn't
Out of the Blue helps a private circle of family and friends coordinate encouraging check-in calls. It is a coordination tool only. It is not a medical, therapeutic, monitoring, or emergency service, and no part of it should be relied on in a crisis. If someone is in danger or needs urgent help, contact local emergency services (000 in Australia) or a crisis line such as Lifeline (13 11 14).
Accounts
Account holders must be 18 or older, or use the service with the consent and involvement of a parent or guardian. Keep your password to yourself; you're responsible for activity on your account. Provide accurate details — the email address is how you recover access.
Your circle's content
Tasks, times, and notes belong to you and your circle. You give us only the limited permission needed to store and display them to your circle and operate the service. We claim no other rights over your content.
Subscriptions and billing
- Each circle costs A$7 per month (including one loved-one account, up to 10 supporters, and a fair-use allowance of 120 check-in texts per month), billed through Stripe and renewing automatically.
- You can cancel anytime through the billing portal; the circle stays active until the end of the period already paid for, then pauses.
- If a payment fails, the circle pauses: history stays visible, new tasks and check-in alerts stop, and nothing is deleted. Fixing payment resumes everything exactly where it was.
- Nothing in these terms limits your rights under the Australian Consumer Law. For billing problems or refund requests, email support@outoftheblue.app.
Fair use
Use the service only for its intended purpose and only with people who have chosen to take part. Don't use it to harass, monitor someone without their knowledge and agreement, break the law, or probe or disrupt the service. We may suspend accounts that do.
Availability
We work to keep the service reliable, but can't promise uninterrupted operation. SMS delivery depends on phone carriers and may occasionally be delayed or fail; the app records failed alerts so they're never silent.
Ending things
You can stop using the service and request full deletion of your account or circle at any time. We may suspend or close accounts for serious or repeated breaches of these terms.
Liability
To the extent the law allows, our liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. Nothing here excludes rights that cannot be excluded under Australian law.
These terms
Australian law (Queensland) governs these terms. If we change them, the new version will be posted here with an updated date; continuing to use the service after a change means you accept it.
